1.3 This privacy policy (this “Policy”) explains how we collect, use, disclose, store and otherwise handle personal information in connection with your use and our operation of Lawcadia.com, or otherwise when you interact with us. We may change this Policy from time to time. We will publish any changes on Lawcadia.com and, where appropriate, notify you by email or within the platform. Where required by applicable law, we will obtain your consent to material changes.

This Policy applies to users located in Australia, the United States and all other jurisdictions except for the European Union and the United Kingdom, which are governed by a separate privacy policy. This Policy does not apply to any personal information that we collect or hold about our employees.

(c) if you are intentified as lead partner for a matter on Lawcadia.com, we may collect ratings and feedback about your law firm which will attach to your Lawcadia profile in accordance with our Ratings Policy; and

(d) if you represent client engaging a law firm on a matter that is registered on Lawcadia.com, then we will collect information about your views and opinions on the performance of the law firm engaged for the matter on Lawcadia.com in accordance with our Ratings Policy.

If we are not able to collect your personal information, we may not be able to provide you with access to Lawcadia.com or our services or do business with you or the organisation with which you are connected.

3.2 Information you provide us

Any information that you provide via Lawcadia.com or our contact numbers and addresses will be collected and stored by us. For example, we collect your email and, if you provide it, other contact details when you subscribe to our email lists.

We may monitor and record calls and other electronic communications that you make to us in certain circumstances. For example, calls to us may be monitored and recorded for training and customer service purposes.

(f) To meet our legal and regulatory obligations and protect our legitimate business interests and legal rights

Where required by law or where we believe it is necessary to protect our legal rights, interests and the interests of others, we may use information about you in connection with legal claims, compliance, regulatory, and audit functions, and disclosures in connection with the acquisition, merger or sale of a business. We also use your information to consider job applicants for current and future employment and to manage our relationships with companies, law firms and other users of Lawcadia.com.

(g) To promote safety and security

We use information about you and your use of Lawcadia.com and any other of our services to verify accounts and activity, to monitor suspicious or fraudulent activity and to identify violations of this Policy.

(h) To undertake activities for which we have obtained your consent

We use information about you where you have given us consent to do so for a purpose not listed above. For example, we may publish testimonials or featured law firm or client stories to promote Lawcadia.com, with your permission.

5.1  We disclose personal information to:

(a) our contractors, agents, service providers and professional advisors;

(b) other users of Lawcadia.com as permitted by the functionality of Lawcadia.com or the settings that we have made available on Lawcadia.com – including:

(i)    the names, contact details, expertise and experience of law firm partners to any companies to whom they submit a tender response;

(ii)    the names and contact details of company representatives will be disclosed to any law firm partners who are requested by that company representative to provide a proposal; and

(iii)   ratings information about law firms and partners will be disclosed to companies and other users in accordance with our Ratings Policy;

(c) such third parties as expressly permitted in our Terms and Conditions for Law Firms, if you are a law firm user, or in our Terms and Conditions for Corporate and Government Clients, if you are a company or government user;

(d) any person that you consent to us disclosing your personal information; and

(e) governmental or regulatory authorities, whether in Australia or elsewhere, having jurisdiction over us, Lawcadia.com or any of our services, or any companies, law firms or other users of Lawcadia.com or any of our services.

5.2 We may disclose personal information overseas where necessary to provide our services and will take reasonable steps to ensure appropriate protections are in place.

 6. How do we protect your personal information?

6.1 We use data hosting service provider, Amazon Web Services, in Australia and the United States to host the information we collect, and we apply administrative, technical and organisational safeguards designed to protect personal information. However, no system is impenetrable and due to the inherent nature of the Internet, we cannot guarantee that data, during transmission through the Internet or while stored on our systems, is absolutely safe.

7. Where is your personal information hosted and processed?

7.1 The Lawcadia platform to which your personal information is sent, is provided by Lawcadia and is hosted by a trusted third-party service provider in Australia.

7.2 Where personal information is accessed from or transferred to locations outside the country in which you provide it, we implement safeguards consistent with applicable laws.

8. Your personal information rights

8.1 You have certain choices available to you when it comes to your personal information. You may request access to or correction of personal information we hold about you.

8.2 You can ask for access or correction by contacting us using the details provided in section 10 below. We will verify your identity before responding to requests.

8.3 We may refuse requests where permitted and required by law and will explain our reasons.

8.4 If we make a correction and we have disclosed incorrect information about you to others, you can ask us to tell them about the correction. We will do so unless there is a valid reason why not to do so.

8.5 We may refuse access to your personal information in various circumstances, including where:

(a) providing access would have an unreasonable impact on the privacy of others;

(b) the request is frivolous or vexatious;

(c) the information relates to existing or anticipated legal proceedings and would not be accessible by the process of discovery in those proceedings;
